Fines and Penalties
Litter and dumped rubbish is ugly, creates a health risk and harms our environment.
It is also illegal, regardless of WHO does it.
Council has a number of powers to enforce and prevent environmental damage occurring from pollution incidents such as dumped rubbish and littering.
Council Rangers patrol our streets day and night. People found responsible for littering or dumping rubbish can be fined under the Protection Of the Environment and Operations (POEO) Act 1997.
They can also be issued with a notice under the POEO Act 1997 or an order under the Local Government Act 1993. Notices can be issued to residents, owners, owners' corporations, strata managers or real estate agents.
Penalties for Dumped Rubbish
Under the POEO Act 1997 the following fines can be issued:
- Section 143 - Unlawful transporting of waste - eg. for transporting and dumping rubbish onto the footpath from inside a property - $750 fine for individuals, $1,500 for corporations
- The penalty for transporting hazardous waste (eg. asbestos) is $1,500 for individuals and $5,000 for corporations
- Section 145 - Littering (small item - individuals only) - eg. a small shopping bag of rubbish dumped on the street - $60 fine.
- Section 145 - Littering - eg. illegally dumped rubbish outside a property; empty boxes dumped in a laneway by a business - $200 fine for individuals, $400 for corporations.
- Section 145A - Aggravated littering - eg. dumped rubbish that includes broken glass - $375 fine for individuals, $700 for corporations.
